Cyber Crimes and Cyber Laws in India


Hi everyone! As we know that cyber crimes are increasing rapidly day by day because due to unawareness of cyber crimes and laws. In this digital era all works are now done on internet or computer. Our life are totally dependent on this. So, we have to know about cyber crimes and their related laws.

The 'cyber crime' is not yet defined in any law in India. It may be defined as "any unlawful activities through the help of computer or internet for targeting any purpose". The cyber includes financial crimes or security scam, sale of arms online or any articles prohibited in law, pornography, online gambling, intellectual property crime, e-mail spoofing, online forgery of documents, online defamation, cyber or computer stalking.

Cyber crime is committed only computer or internet or e-mail through unauthorized access to computer, computer system, computer system, computer networks, theft of information of others stored in computer, internet theft, web jacking and damaging to computer system. The cyber crime is separate from conventional or common form of crime.

Recently, Facebook data leak scandal happens and information of over 80 million Facebook users was allegedly harvested by data analytics and Cambridge Analytica (Facebook Data Leak). In Aadhar case Supreme court of India stated that, "it is a "real apprehension" that a leak in aadhar data may sway elections and cause a severe dent to democracy" (aadhaar-data-leak). 

Causes of cyber crime ---

  1. capacity to store data in small space
  2. easy to access computer networks
  3. complexity of operating system
  4. negligence of victims of cyber crime to safe their data in computer software.

Ways of committing cyber crime ---

  1. unauthorized access to computer systems or hacking
  2. theft information in electronic form
  3. e-mail gambling
  4. virus attacks
  5. internet time theft
  6. web jacking

Types of cyber crime ---

      1.Cyber crime against privet individuals viz:

    • harassment via e-mail
    • cyber stalking
    • dissemination of obscene materials
    • defamation
    • unauthorized access over computer system
    • indecent exposer
    • e-mail spoofing
    • cheating and/or fraud

      2.Cyber crime against Government or organisation viz:

    • unauthorized access/control over computer system
    • possession of unauthorized information
    • cyber terrorism against the Government or Department
    • distribution of pirated software

      3.Cyber crime against society at large viz:

    • pornography
    • polluting young persons through indecent exposer
    • trafficking
    • online sale of illegal articles
    • online gambling
    • online forgery or fraud


Cyber laws in India --- 

The Information Technology Act, 2000 is the principal law to deal with cyber crime. This act provides for legal recognition for transaction carried out by means of electronic data interchange and other means of electronic communication, which involves the use of alternative to paper-based methods of communication and storage of information, to facilitate electronic filing of documents with the government agencies. Most importantly the Information Technology (Amendment) Act in 2008 plays a major role to combat cyber crime -- Besides Information Technology Act, 2000 the Copyright Act, Arms Act, Indian Penal Code, Indian Evidence Act, Bankers' Book Evidence Act, Reserve Bank of India Act, make some vital provisions to combating other type of cyber crime. 


The various offences related to internet which have been punishable under IT Act and the IPC are enumerated below:

1. Cyber crimes under IT Act

  • Tampering with computer source document (section 65)
  • Hacking with Computer systems, Data alteration (section 66)
  • Publishing obscene information (section 67)
  • Unauthorized access to protected system (section 70)
  • Breach of confidentiality and privacy (section 72)
  • Publishing false digital signature certificate (section 73)

2. Cyber crimes under IPC

  • Sending threatening message by email (section 503)
  • Sending defamatory messages by email (section 499)
  • Forgery of electronic record (section 463)
  • Bogus website, cyber fraud (section 420)
  • Email spoofing (section 463)
  • Web jacking (section 383)
  • Email abuse (section 500)


Cyber crimes under Special Acts:--
  • Online sale of Drugs under Narcotic Drugs and Psychotropic Substances Act
  • Online sale of Arms Act

Conclusion:--  Users of computer systems and internet are growing rapidly day by day. It is easy to access the information easily within a few seconds by internet and we know that this internet is the medium of huge information and a large base of communication around the world. Therefore, citizens have to take precautionary measures while using the internet which will assist in challenging this major threat Cyber Crime.
